Now, the court is remanding the case for a new trial. But even if the case is remanded, the outcome will likely not be good for Spirit.

9th Circuit Court of Appeals

This is because the 9th Circuit Court of Appeals dealt a serious blow to Randy Wolfe. According to the court’s opinion, the district court erred when it instructed the jury that they had to determine whether Led Zeppelin’s song was virtually identical to Spirit’s.

While Led Zeppelin won the first round of the case, the appeals court decision was a major win for the defendants. The decision effectively precludes the Blurred Lines-type claims.

As a result, the Stairway To Heaven case ended in October. Earlier this year, the US Supreme Court declined to hear the case. Until that happens, however, the ruling will stand.
