Spirit, the band that toured with Led Zeppelin in the late sixties, is suing the band for copyright infringement. They claim that the opening riff of “Stairway to Heaven” is similar to a riff from their 1967 song Taurus. The two bands performed on the same bill in 1970.
However, the jury in the case found that the songs weren’t so similar that they should be considered a copy. That’s because the chord progressions in the songs are fairly simple. Also, the jury believed that the similarities between the two songs were coincidental.
Now, the court is remanding the case for a new trial. But even if the case is remanded, the outcome will likely not be good for Spirit.
9th Circuit Court of Appeals
This is because the 9th Circuit Court of Appeals dealt a serious blow to Randy Wolfe. According to the court’s opinion, the district court erred when it instructed the jury that they had to determine whether Led Zeppelin’s song was virtually identical to Spirit’s.
While Led Zeppelin won the first round of the case, the appeals court decision was a major win for the defendants. The decision effectively precludes the Blurred Lines-type claims.
As a result, the Stairway To Heaven case ended in October. Earlier this year, the US Supreme Court declined to hear the case. Until that happens, however, the ruling will stand.
In the meantime, Led Zeppelin have yet to comment on the results of the case. The band has time to weigh their options.
